General Terms and Conditions (GTC)

1. DEFINITIONS AND INTERPRETATIONS

Visitors and users (hereinafter referred to as the "Customer") of the 3D Dinner Show – Le Petit Chef: Online reservation platform (hereinafter referred to as the "Platform") agree to comply with the following terms of use (the "General Terms and Conditions") before purchasing seats for the Le Petit Chef experience, the 3D dinner show (including online purchases or on-site purchases at the hotel or restaurant):
"Seats" or "Event" refers to the Le Petit Chef/Dinner Time Story show. We are authorized to sell you seats.
"We" refers to the organizer. "Us" and "Our" shall be construed accordingly.

"You" refers to the purchaser of the seat or anyone who, in our reasonable opinion, is acting with your authority or permission. "Your" shall be construed accordingly.

2. SEATS

1) All prices are in Euros (€) and include service charge and statutory VAT.

2) All seats for Le Petit Chef events at the respective venues are sold subject to availability and these General Terms and Conditions. Please read these General Terms and Conditions carefully before purchasing. If you have any questions, please contact us before completing the purchase. A completed reservation process is considered acceptance of these General Terms and Conditions.

3) Confirmation for the purchase of seats for an event will be sent to the email address you provided in the system upon successful completion of the purchase.

4) Seat assignment for the event depends on availability and on-site arrangement by the operator (projector location, etc.). Changing or reserving a desired seat is not possible.

5) Presentation of a valid booking confirmation is mandatory for admission to the event.

6) The booking confirmation is only valid for the day of the event and the booked time.

7) 1 (one) seat can only be booked for 1 (one) person.

8) The resale of already reserved seats is prohibited. We reserve the right to cancel any resold seat(s).

9) Any use of the websites lepetitchef.de / lepetitchef.com and their content and data for illegal activities, as well as for the purpose of selling or reselling seats, for advertising or business purposes, or otherwise to obtain benefits, including the resale of seats, is prohibited without the prior written consent of the organizer.

We reserve the right to levy a contractual penalty of up to 10,000 Euros from any customer who has violated this provision.

10) We assume no liability for lost, stolen, or destroyed booking confirmations.

11) We are only liable for bookings made at sales points managed by us.

12) Ownership or possession of a booking confirmation does not grant you any rights (neither implicitly nor otherwise) to use, modify, copy, or otherwise deal with the symbols, trademarks, and/or logos appearing on the booking confirmation. This also includes the right to intellectual property.

13) Any reservation or booking confirmation obtained in violation of these General Terms and Conditions is invalid. All rights transferred or established by such a reservation are void. Any person attempting to use such an invalid reservation to gain access to a Le Petit Chef event or to gain entry will be considered a trespasser. This will lead to exclusion from the event and legal action. Invalid reservations are non-refundable.

14) Reservations made can be transferred to another person. Please notify us of such a change no later than 4 (four) hours before the booked time at: [email protected]. However, requests regarding food or menu cannot be changed. These are based on the original booking.

15) By performing an action (including reservation, booking, voucher purchase) on the booking website, a customer confirms:
a. They are a customer (m/f/d) of at least 18 years of age and have full passive and active legal capacity to use the website.
b. That, if the customer is a legal entity, they are its representative who has all and any authority to use the services of the platform on behalf of this legal entity and to enter into all obligations for this legal entity.
c. To have read, fully understood, and to comply with the General Terms and Conditions of the online service Le Petit Chef (2spicy.de).
d. If the purchasing customer is younger than 18 years old, to be able to provide written proof of the presence or signature of parents or legal guardians who are at least 18 years old or older.

3. PRICE AND PAYMENT

1) The price for your reservation corresponds to the price set at the time of acceptance of your online order.

2) If paying by credit card, you will find the payment transaction on your credit card statement under the name "Le Petit Chef".

3) Individual discount/promotional codes do not apply in conjunction with other ongoing promotions, discounts, vouchers, or bonus cards.

4. CHANGES TO THE EVENT

The organizer or the operator of the event venue reserves the right to postpone, delay, cancel, interrupt, or terminate the event due to technical problems, dangerous situations, or other important reasons beyond any reasonable control.

5. LIABILITY

1) In the event of a change to the event as mentioned in point 4, 2Spicy Entertainment GmbH or the operator of the event location shall not be liable for costs incurred by the customer for travel, accommodation, or other related services.
2) Decisions to postpone or delay events on site are beyond the control of the organizer, 2Spicy Entertainment GmbH. 2Spicy Entertainment GmbH is not liable and offers no compensation or refund of incurred costs. A full refund (excluding the booking price) will be granted if the organizer, 2Spicy Entertainment GmbH, makes the cancellation.

6. CANCELLATION OR POSTPONEMENT OF AN EVENT

It is your responsibility to determine whether the event has been canceled or postponed, as well as to find out the date and time of a rescheduled event. In the event of cancellation or postponement of an event, the organizer, 2Spicy Entertainment GmbH, will make every effort to inform you.

7. USE OF INFORMATION AND DATA

To facilitate the purchase of seats or the provision of other services, data is collected from those who register on the Le Petit Chef homepage.

8. ADMISSION REQUIREMENTS FOR THE 3D DINNER SHOW

1) You must be at least 18 years old to participate in the Le Petit Chef/3D Dinner Show. If a guest is younger than 18 years, the presence and signature of parents/legal guardians who are at least 18 years old or older is required.

2) Punctuality is very important for the 3D Dinner Show experience. We recommend that you arrive at least 20 (twenty) minutes before the start of the show. If your arrival is delayed and the show has already started, the organizer will not repeat the parts you missed, and no refund will be given.

3) The organizer does not guarantee that the prepared dishes are free of common allergens such as nuts, dairy products, gluten, etc. We recommend that you look closely at the menu on our website before booking the event.

4) You are responsible for your own health and safety. You must observe all precautions regarding your state of health, including diabetes, food allergies and intolerances, etc., without recourse to the organizer.

5) The organizer or the on-site operator reserves the right to refuse or deny you entry to the venue in justified cases, e.g., due to health and safety problems, licensing reasons, or if a booking is invalid.

6) The organizer or the on-site operator also reserves the right to ask you to leave the venue at any time and for any valid reason. They may take all appropriate measures to enforce this right.

7) For example, the on-site organizer may remove anyone who:
a) behaves in a manner that, in the reasonable opinion of the organizer, disturbs, has disturbed, or could disturb the enjoyment of other customers; and/or
b) uses threatening, abusive, or offensive language, or exhibits corresponding behavior, or in any way provokes, or behaves in a manner that could disturb the peace of the organizer and other customers; and/or
c) in the reasonable opinion of the organizer, is under the influence of alcohol or drugs.

8) You are obliged to follow the instructions and directions of the organizer, staff, and on-duty security personnel. Anyone who has been denied entry due to their own behavior, as described in the examples above, but not exclusively, will not receive a refund.

9) You voluntarily assume all risks and dangers associated with the event, regardless of whether they occur before, during, or after the actual event, including death, personal injury, loss, damage, or liability.

10. RESTRICTIONS AND PROHIBITIONS

1. The use of devices for recording or transmitting (by digital or other means) audio, visual, or audiovisual material or information or data at the venue is strictly prohibited, unless the use is for personal use and sharing on personal social media.

2. Unauthorized recordings, tapes, films, or similar items may be confiscated and destroyed. Any recording made during the event constitutes a breach of these terms and automatically belongs to the organizer. The organizer is not liable for loss, theft, or damage to confiscated items.

3. The organizer reserves the right to use photos/videos taken at a Le Petit Chef 3D Dinner Show event without the express written permission of the persons depicted in the photo/video. The organizer may use the photo/video in publications or other media materials produced, used, or commissioned by the organizer, including, but not limited to: brochures, invitations, books, newspapers, magazines, television, websites, etc.

4. Any person who does not wish to have their image taken or distributed must inform the organizer in writing of their concern and enclose their photo. The organizer will use the photo for identification purposes and will treat it confidentially.

5. The following are generally prohibited at the venue:
a) Animals;
b) Own food and drinks (unless permitted by the organizer);
c) Bottles, cans, or glass containers (unless permitted by the organizer);
d) Any item that can be considered a potential weapon, including sharp or pointed objects (e.g., knives);
e) Possession or use of illegal substances
f) Professional/commercial recording equipment (unless permitted by the organizer).

6. You agree to follow the instructions of the authorized personnel of the organizer to carry out a search for prohibited items, including weapons, controlled, dangerous, and illegal substances.

7. The organizer, the owner of the venue, the sponsors, the subcontractors, their representatives and employees are not liable for death, personal injury, loss or damage caused during the stay at the venue or during the event, nor are they liable for a postponement of the Le Petit Chef 3D Dinner Show. The purchaser of the seat buys and accepts the seat voluntarily and assumes all risks and dangers associated with the event, regardless of whether they occur before, during, or after the event, including death, personal injury, loss, damage, and liability.

8. The organizer has the unrestricted right to completely cancel any 3D Dinner Show event under the following conditions, which are considered unsafe (with a full refund granted only for the purchased seat):
a. Power outage originating from the operator of the venue.
b. Flood, hurricane, earthquake, or another force majeure event at the venue.
c. Any politically motivated restriction/strike/curfew at or around the venue.

12. REFUNDS

1) Purchased seats cannot be refunded or canceled after purchase, except in the case of cancellation by the organizer themselves.
2) If an event is canceled by the organizer, you have the choice to change the date or request a refund of the payment made. If you choose to refund the payment made, this process can take up to 14 working days.

3) If the event is postponed, the seats purchased for the original date are valid for the new date, unless otherwise communicated.

13. GIFT VOUCHER

These conditions apply to all purchased vouchers.

Redemption

Gift vouchers must be redeemable within 3 years of purchasing the voucher ("Expiry Date"). Remaining balances will be credited to your gift voucher account until the expiry date, after which they can no longer be used.
Gift vouchers can only be redeemed on www.lepetitchef.de/gutschein for products that are approved for purchase with vouchers. They are not redeemable on other platforms.
Gift vouchers can only be redeemed via the regular order form in the online shop (shopping cart) or in one of our official partner locations where Le Petit Chef takes place.
If the value of the voucher is not sufficient for your order, you can pay the difference with another payment method approved by us.
Only one gift voucher can be used per order. Multiple vouchers cannot be combined.

General

For the redemption of the gift voucher at www.lepetitchef.de/gutschein and in our official fan shops, the General Terms and Conditions and data protection provisions of 2Spicy Entertainment GmbH apply, which can be accessed on the respective website.
When ordering a gift voucher, the complete payment details must be provided in the order form. Subsequent addition of information is not possible.
A cancellation of voucher orders can only be made two weeks after purchase.
2Spicy Entertainment GmbH may send the purchaser of gift vouchers information about the redemption status of the gift voucher.

Restrictions

Gift vouchers cannot be redeemed outside of the online booking www.lepetitchef.de. Gift vouchers cannot be redeemed on websites other than the approved ones.
Retrospective application of a voucher is not possible. The balance of a voucher will neither be interest-bearing nor paid out in cash.
Gift vouchers or gift voucher balances cannot be paid out in cash, topped up, transferred for value, offset against outstanding claims, or transferred to another customer account. Resale of gift vouchers is also not permitted.
Vouchers cannot be redeemed for the purchase of vouchers.

Liability and Risk of Loss

2Spicy Entertainment GmbH assumes no liability for typing errors in the email address of the voucher recipient. Likewise, 2Spicy Entertainment GmbH assumes no liability for loss, theft, misuse, or delayed transmission (e.g., due to technical difficulties) of gift vouchers.

Fraud

In the event of fraud, an attempt to deceive, or suspicion of other illegal activities in connection with a gift voucher purchase or voucher redemption, 2Spicy Entertainment GmbH is entitled to close the corresponding customer accounts and/or demand an alternative payment method. There is no claim to activation or payout of affected vouchers.
